Terms of Sale

1. Who we are
These Terms of Sale govern every quote, order and supply of goods by The Star Guys ("we", "us", "our"), trading from Loxton, South Australia. By accepting a quote, placing an order or paying a deposit, you ("the customer", "you") agree to these terms.
2. Quotes & pricing
- All quotes are valid for 7 days from the date of issue. After that, pricing may change without notice due to steel, freight and currency movements.
- Prices are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. GST is added at invoicing where applicable.
- Freight figures shown on our site or in quotes are estimates. Final freight (port handling, line-haul, door delivery) is invoiced separately once the container is booked, lands or is dispatched.
- We reserve the right to correct manifest errors, pricing errors, or typographical mistakes before goods are dispatched.
3. Minimum order
Our standard minimum order is one 20ft container (~21 tonnes). Smaller orders may be quoted but will carry a higher per-unit cost. We reserve the right to decline orders that fall below commercially viable thresholds.
4. Payment
- A non-refundable deposit (typically 30%) is payable to secure stock and container space.
- Balance is payable in cleared funds before goods are released from port or yard.
- Late payment may attract interest at the RBA cash rate plus 4% per annum and reasonable recovery costs.
5. Title & risk
Title in the goods passes to you only when we have received payment in full in cleared funds. Risk passes to you on dispatch from the port or our yard — once goods are loaded for delivery they are at your risk and you should insure accordingly.
6. Delivery & lead times
- Containers land at your nearest Australian port (Melbourne, Sydney, Brisbane, Adelaide or Fremantle). Door-to-door delivery is quoted as a separate leg.
- Lead times and ETAs are indicative only. We are not liable for delays caused by shipping lines, ports, customs, weather, industrial action, road closures or any other event outside our reasonable control.
- You are responsible for site access, unloading equipment (forklift, telehandler, etc.) and a competent person to receive the goods. Demurrage, re-delivery and waiting-time charges resulting from refused or failed delivery are payable by you.
7. Inspection & claims
You must inspect goods on delivery and note any visible damage on the delivery docket. Claims for transit damage, shortage or defect must be made under our Returns & Refunds Policy within the timeframes stated there.
8. Liability
To the maximum extent permitted by law, our total liability to you in connection with any goods supplied is limited, at our election, to the replacement of the goods, the resupply of equivalent goods, or a refund of the price paid for the affected goods.
We are not liable for any indirect, consequential or economic loss, including (without limitation) loss of profit, loss of livestock, loss of fencing labour, downtime, or loss of use, however caused.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
9. Force majeure
We are not in breach of these terms if performance is delayed or prevented by events beyond our reasonable control, including shipping disruptions, pandemic, war, embargo, natural disaster or government action.
10. Governing law
These terms are governed by the laws of South Australia. The parties submit to the exclusive jurisdiction of the courts of South Australia.
